ACTIVITY PARTICIPATION AGREEMENT, WAIVER, AND RELEASE

Please Note: All pool users will be required to submit a signed hard copy of the Waiver of Liability and Acknowledgement to COVID-19 Response Policy to the Foundation Office prior to using the swimming pools.

We are pleased to announce the 2020 Hidden Valley Foundation pool season will commence on June 19, 2020. This season the Hidden Valley Foundation will be implementing measures recommended by the Centers for Disease Control and Prevention (the “CDC”) that are designed to reduce the spread of the Coronavirus, as required by the Pennsylvania Office of the Governor and the Pennsylvania Department of Health and Human Services.  These measures will include additional maintenance, changes to our operations, and a new pool policy of rules and guidance in response to the Coronavirus pandemic. By taking these steps together as a community, we hope to preserve the Hidden Valley Foundation pools as a safe environment for our members and their guests to enjoy. 

 

How We Are Making the Pool a Safe Environment

We will operate the Hidden Valley Foundation pools in compliance with state law and federal guidance in order to maintain a safe environment. The guidance is subject to change and we will adjust our policies accordingly. As of the date of this letter, we will implement the following measures according to the most recent guidance:

 

1. Limited Operating Capacity.  This season, the Hidden Valley Foundation will only operate the South Ridge Pool. The Pool will be available for use 7 days a week, with 2 sessions a day. Each session will be approximately 4 hours long and there will be with a maximum capacity of 150 people per session.  There will be a 1 hour break between each session for cleaning of the Pool space.

 

2. Reservation System. In order to use the Pool, members and the guests will make reservations through the Hidden Valley Foundation Home Portal, as they do with all other activities on the Hidden Valley mountain. The reservation system is designed to maximize member and guest usage under the limited operating capacity.  In the event the reservations for a Pool session do not hit the maximum capacity of 150 people, walk-ins will be permitted. 

3. Designated COVID-19 Points of Contact and Staffing during Pool Operations.  Jon Sabo, the Executive Director of the Hidden Valley Foundation, is the Chief COVID-19 Officer and is charged with the development and implementation of policies and operations to address COVID-19 issues. Madison Duran, the pool manager, shall be responsible for responding to COVID-19 concerns by staff, members, and guests. You need JavaScript enabled to view it..  During each session, onsite pool attendants shall monitor pool user compliance with rules. Lifeguards who are actively lifeguarding shall not be responsible for monitoring rule compliance. A security guard will be on duty each session to assist with maintaining occupancy limits and to address safety concerns.

4. Cleaning, Disinfection, and Adequate Supplies to Support Healthy Hygiene.  We will clean and disinfect frequently touched surfaces and shared objects after each session. We will supply soap, hand sanitizer with at least 60 percent alcohol (for staff and older children who can safely use hand sanitizer), paper towels, tissues, and no-touch trash cans.

5. Modified Layouts and Signage to Promote Safe Behaviors. We have modified the Pool deck layout to ensure that in standing and seating areas, pool users can remain at least 6 feet apart from other users who are not a part of their party. We will post signs about how to stop the spread of COVID-19 and properly wash hands.

 

What We Need From Members and Guests

We are implementing the Emergency COVID-19 Response Pool Policy and the Emergency COVID-19 Response Rule Enforcement Policy (the “COVID-19 Policies”) for the use of the Pool that will encourage pool users to practice behaviors that promote safety and have pool users acknowledge the ongoing risk posed by the Coronavirus. A copy of the COVID-19 Policies are attached to this letter. The COVID-19 Policies supplement the existing Hidden Valley Pool Policy and the Uniform Enforcement Policy for the 2020 pool season.

 

All members and guests who wish to use the facilities will be required to read the COVID-19 Policies and provide a signed copy of the Hidden Valley Emergency COVID-19 Response Acknowledgement attached to the Emergency COVID-19 Response Pool Policy before entry. 

 

The 2020 Hidden Valley Foundation pool season will be different from prior years but we will do our part to ensure the Pool remains a place of community, relaxation and fun.  We thank you for your cooperation. 

 

 

 

Policy Name: Emergency COVID-19 Response Pool Policy

Purpose: This policy sets forth mandatory rules and discretionary guidance designed to supplement the existing Hidden Valley Pool Policy rules, inform the Hidden Valley Foundation community of the risks posed by the Coronavirus, encourage behaviors that slow the spread of the Coronavirus, and comply with existing state requirements and federal guidance.

 

Policy Statement:

Rules 

Compliance with this new set of rules in addition to the existing pool usage rules is mandatory for pool admission. Members and guests who violate these Rules shall be subject to the enforcement actions set forth under the Emergency COVID-19 Rules Enforcement Policy.

1. Anyone exhibiting symptoms of the Coronavirus, or that has tested positive for the Coronavirus, or that was exposed to someone with the Coronavirus in the last 14 days is prohibited from entering the premises of a Hidden Valley Foundation pool.

2. All pool users must independently verify prior to entering the premises of a Hidden Valley Foundation pool, that they and the members of their party, including minor children, do not have symptoms of the Coronavirus , have not tested positive for the Coronavirus, and to their knowledge, were not exposed to someone with the Coronavirus in the last 14 days. 

3. All pool users shall refrain from engaging in disorderly conduct while located on the premises of a Hidden Valley Foundation pool. Disorderly conduct includes but is not limited to a refusal to practice social distancing from other pool users outside of his or her party and any deliberate action that creates an unsanitary or unsafe condition. 

4. All pool users over the age of 12, including members and their guests, shall provide a signed copy of the Emergency COVID-19 Response Acknowledgement attached to this policy before entering the premises of a Hidden Valley Foundation pool. 

 

Guidance 

All pool users are strongly encouraged to follow this guidance while using the pool. 

1. Be aware that there is an element of risk in connection with the Coronavirus by using a Hidden Valley Foundation pool and participating in Hidden Valley Foundation activities.

2. All pool users should wash hands often and cover coughs and sneezes. 

3. Be aware that social distancing will not be practiced in order for Hidden Valley Foundation staff or other emergency responders to rescue a distressed swimmer, provide first aid, or perform cardiopulmonary resuscitation, with or without an automated external defibrillator.

4. Be aware that in the event of an emergency evacuation of the premises of a Hidden Valley Foundation pool, pool users may not be able to maintain social distancing of 6 feet as they exit.

5. Be aware that in the event of an emergency evacuation of the premises of a Hidden Valley Foundation pool, pool users may not be able to maintain social distancing of 6 feet as they exit.

6. All pool users over the age of 2 are strongly encouraged to wear a face mask while they are using the facilities. Masks shall not be worn while in the water because cloth face coverings can be difficult to breathe through when wet.

7. Keep 6 feet away from other pool users that are not a part of your party.

8. Do not share items that are difficult to clean, sanitize, or disinfect or that are meant to come in contact with the face (for example, goggles, nose clips, and snorkels).

9. Do not share items such as food, equipment, toys, and supplies.

10. Avoid group events, gatherings, or meetings both in and out of the water. If planned events must be conducted, stagger drop-off and pick-up times, as much as possible.

11. Parents and guardians should consider if their children are capable of staying at least 6 feet apart from people outside of their party before taking them to a Hidden Valley Foundation pool.

 

 

HIDDEN VALLEY EMERGENCY COVID-19 RESPONSE ACKNOWLEDGEMENT

I acknowledge receipt and review of the Hidden Valley Emergency COVID-19 Response Pool Policy and pledge to comply with the rules and guidance set forth therein.

I acknowledge and accept that there is an element of risk in connection with the Coronavirus by using the Hidden Valley Foundation pools and participating in Hidden Valley Foundation activities.

Policy Name: Emergency COVID-19 Rules Enforcement Policy

Expiration Date: This Emergency COVID-19 Rules Enforcement Policy takes effect June 19, 2020. 

 

Purpose: Due to the ongoing serious health risks created by the Coronavirus pandemic, it is necessary for the safety of the community to implement the following enforcement procedure for the Hidden Valley COVID-19 Emergency Response Pool Policy. This policy is designed to supplement the existing Hidden Valley Uniform Enforcement Policy. In the event of a conflict between this policy and the Hidden Valley Uniform Enforcement Policy, this policy shall control. 

 

Enforcement Policy:

1. Members and guests who use the Hidden Valley Foundation pools shall abide by the Hidden Valley Emergency COVID-19 Response Pool Policy, which contains mandatory Rules and discretionary Guidance. Members are responsible for ensuring their guests receive and review a copy of the Hidden Valley Emergency COVID-19 Response Pool Policy and this Hidden Valley Emergency COVID-19 Response Pool Policy. 

 

2. Any member or guest who has violated a Rule under the Hidden Valley Emergency COVID-19 Response Pool Policy, as determined by the Hidden Valley Pool Manager on duty, shall be immediately escorted off the premises of the Hidden Valley Foundation pools and shall be prohibited from using the Hidden Valley Foundation pools for a thirty (30) day Probationary Period, commencing from the date of the violation. 

 

3. Any member or guest who returns to the Hidden Valley Foundation pools after a thirty (30) day Probationary Period and then violates a Rule under the Hidden Valley Emergency COVID-19 Response Pool Policy, as determined by the Hidden Valley Pool Manager on duty, shall be immediately escorted off the premises of the Hidden Valley Foundation pools and shall be prohibited from using the Hidden Valley Foundation pools for the remainder of the 2020 pool season. 

 

4. If a guest of a member violates a Rule under the Hidden Valley Emergency COVID-19 Response Pool Policy, the member shall receive a written warning from the Hidden Valley Foundation Pool Manager. Any member who receives two (2) written warnings from the Hidden Valley Foundation Pool Manager shall have his or her guest privileges suspended for a thirty (30) day Probationary Period. 

 

5. Parents and guardians shall be held responsible and subject to the enforcement actions described in this policy for the actions of their minor children, as if the parent or guardian committed the violation of the Hidden Valley Emergency COVID-19 Response Pool Policy.

 

6. Appeals for enforcement actions under this policy must be made in writing to the Hidden Valley Foundation Pool Manager Madison Duran by emailing This email address is being protected from spambots. You need JavaScript enabled to view it.. The appeal shall set forth the reasons for the member or guest’s appeal request. Within one (1) week of the receipt of an appeal, the Board shall consider the appeal and issue a final written decision to the appellant by email.

Activity Participation Agreement, Waiver, and Release

 

In consideration of being permitted by Hidden Valley Foundation, Inc. ( the “Foundation”) to participate in activities or events located on the real property owned or operated by the Foundation, including but not limited to the South Ridge Center and the Highlands Center, and all such premises, equipment and facilities located thereon ( “Foundation Property”), sponsored by the Foundation or one of its committees, or activities or events sponsored by the Foundation or one of its committees which occurs away from Foundation Property, I hereby waive, release and discharge any and all claims for damage for personal injury, physical illness, death or property damage which I may have, or which may hereafter accrue to me, as a result of my participation or the participation of my spouse or child,  in activities or events at said Foundation Property or where said sponsored activity or event may take place. This release is intended to discharge in advance the Foundation, its board members, officers, employees and agents, its affiliated associations, its associated homeowner associations, its committee members and associated groups, from any and all liability arising out of or connected in any way with my participation in activities or events on Foundation Property or at any other location of a Foundation-sponsored activity or event, even though the liability may arise out of negligence or carelessness on the part of any party associated with the Foundation as previously defined. It is understood that activities and events such as the ones I will be participating in may involve an element of risk and danger of accidents, physical illness, injury, death or property damage and, knowing those risks, I hereby assume those risks. It is further agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to hold harmless the Foundation, its officers, employees and agents, its associated home owners associations, its committee members and associated groups from any loss, liability, damage, cost or expense which they may incur as the result of my death or any illness, injury or property damage that I may sustain while participating in any activity or event on Foundation Property or at any other location where a Foundation sponsored activity or event is taking place. 

I acknowledge and agree that the Foundation has a legal obligation to comply with all applicable laws, including governmental orders in connection with any communicable diseases of public health significance, pandemics, epidemics, public health emergency declarations, civil commotions, war, terrorist acts, or natural catastrophes.  I acknowledge and agree that the Foundation is exercising reasonable care and by acting in accordance with all applicable laws and governmental orders. I acknowledge and understand that there is an element of risk in connection with communicable diseases by participating in activities or events on Foundation Property or at any other location of a Foundation-sponsored activity or event. I acknowledge that the use of the Foundation Property may, despite the Foundation’s reasonable efforts to mitigate such dangers, result in the exposure to a communicable disease, including COVID-19, which could result in quarantine requirements, serious illness, disability and/or death.  

I understand that by participating in any of the aforementioned activities or events, all Participants consent to photo images taken by the Foundation, its agents, or staff during this activity or event to be used in any or all of the Foundation’s publications and websites. 

I hereby acknowledge, agree and represent that I have inspected and carefully considered the Foundation Property and find the Foundation Property to be safe and reasonably suited for the use or participation by the undersigned. I fully understand and appreciate both the known and potential dangers of utilizing the Foundation Property and participating in Foundation sponsored activities. 

I hereby acknowledge it is my sole responsibility to review and comply with all policies and rules issued by the Foundation in connection with the use of the Foundation Property or participation in Foundation sponsored activities. I acknowledge and understand that failure to abide by the policies and rules of the Foundation may result in the loss of privileges, loss of property rights, or other monetary and non-monetary penalties. I agree to indemnify and to hold harmless the Foundation, its officers, employees and agents, its associated home owners associations, its committee members and associated groups from any loss, liability, damage, cost or expense which they may incur as the result of my failure to comply with all such policies and rules issued by the Foundation.

I UNDERSTAND THAT THIS AGREEMENT, RELEASE AND WAIVER SHALL BECOME EFFECTIVE, WITHOUT NEED OF RENEWAL, UPON THE DATE OF EXECUTION AND WILL CONTINUE FROM THAT DAY FORWARD FOR ANY AND ALL FOUNDATION ACTIVITIES AND EVENTS UNTIL AND UNLESS I FORMALLY REVOKE THIS AGREEMENT  IN WRITING AND DELIVER SAID REVOCATION TO THE FOUNDATION WITH NOTICES OF THE SAME TO THE FOUNDATION’S EXECUTIVE DIRECTOR AT THE FOLLOWING ADDRESS: HIDDEN VALLEY FOUNDATION, INC., EXECUTIVE DIRECTOR, 1900 SOUTH RIDGE DRIVE., P.O. I hereby acknowledge, agree and represent that I have inspected and carefully considered the Foundation Property and find the Foundation Property to be safe and reasonably suited for the use or participation by the Participant. I fully understand and appreciate both the known and potential dangers to the Participant of utilizing the Foundation Property and participating in Foundation sponsored activities.

I hereby affirmatively state that the said Participant is physically able to participate in said activity. I hereby agree to indemnify and hold the Foundation, its board members, officers, employees and agents, its affiliated associations, its associated homeowner associations, its committee members and associated groups free and harmless from any loss, liability, damage, claims, cost or expense, including but not limited to attorney fees, that they may incur as a result of the death or any injury or illness or property damage that the Participant may sustain while participating in activities at or on Foundation Property or any place there is a Foundation-sponsored activity or event if the activity or event does not take place on Foundation Property. I hereby agree to indemnify and hold the persons and entities mentioned above free and harmless from any loss, liability, damage, claims, cost or expense, including but not limited to attorney fees, that they may incur as a result of any misrepresentation made by my execution of this Consent. 

I acknowledge and agree that the Foundation has a legal obligation to comply with all applicable laws, including governmental orders in connection with any communicable diseases of public health significance, pandemics, epidemics, public health emergency declarations, civil commotions, war, terrorist acts, or natural catastrophes.  I acknowledge and agree that the Foundation is exercising reasonable care and by acting in accordance with all applicable laws and governmental orders. I agree to indemnify and to hold harmless the Foundation, its officers, employees and agents, its associated home owners associations, its committee members and associated groups from any loss, liability, damage, cost or expense which they may incur as the result of the Participant’s failure to comply with all such policies and rules issued by the Foundation.
